GlobeEst is a global real estate platform that provides users with the ability to search, browse, list, and discover properties for sale and rent across multiple countries and regions. The Service includes, but is not limited to:

• Property search and listing tools with advanced filtering by location, price, property type, and amenities
• Property detail pages with descriptions, photographs, maps, and pricing information
• User accounts for managing property listings, saved searches, favorites, and notifications
• Property publishing tools for agents, brokers, and property owners
• Mortgage calculator and property market analytics
• Communication features between users, agents, and property owners

The Service is provided "as is" and "as available," and we reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts and Registration

To access certain features of the Service, you may be required to register for an account. When registering, you agree to the following:

• You must provide accurate, current, and complete information during registration and keep your account information updated at all times.

However, by posting User Content on the Service, you grant GlobeEst a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and otherwise exploit such content in connection with the operation and promotion of the Service.
• You represent and warrant that you have all rights, licenses, and permissions necessary to grant us the above license, and that your User Content does not infringe upon the rights of any third party.
• All property listings must be accurate, truthful, and not misleading. You must not list properties you do not have the legal right or authority to list.
• User Content must not contain any illegal, defamatory, fraudulent, abusive, obscene, or otherwise objectionable material.
• We reserve the right to remove, edit, or refuse to display any User Content at our sole discretion, without prior notice or liability.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of GlobeEst and its licensors. 7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GLOBEEST, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including but not limited to property listing information
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors, inaccuracies, or omissions in any content or property listing information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar harmful code that may be transmitted to or through the Service

IN NO EVENT SHALL GLOBEEST'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GLOBEEST IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless GlobeEst and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including without limitation reasonable legal and accounting fees, arising out of or resulting from:

• Your violation of these Terms of Service
• Your violation of any applicable law or regulation
• Your violation of any rights of a third party, including intellectual property rights, privacy rights, or proprietary rights
• Any User Content you submit, post, or transmit through the Service
• Any property listings you create or manage on the Service
• Your interaction with other users of the Service

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

9. Governing Law

These Terms of Service and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The failure of GlobeEst to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

All changes are effective immediately when posted and apply to all access to and use of the Service thereafter.
